Terms & Conditions

These terms and conditions (the Terms) apply to competitions promoted by Wonit Ltd through https://wonit.co.uk (https://wonit.co.uk) (the Website). Please read them carefully before entering. By submitting an entry, you agree to be bound by these Terms and any additional conditions shown on the relevant competition page.

1. The Promoter

1.1 The promoter is Wonit Ltd, a company registered in England and Wales under company number 16428188, whose registered address is 52 Cornwall Street, Manchester, M11 2PS (the Promoter, Wonit, we, us or our).

1.2 You may contact us at info@wonit.co.uk. Postal entries must be sent to the Competition Manager at the address stated in Schedule 1.

1.3 These Terms apply to every competition advertised on the Website unless the relevant competition page expressly states otherwise. The competition page forms part of these Terms. If there is a conflict, any specific condition clearly stated on the competition page will apply to that competition, except that it cannot remove or reduce any mandatory legal right.

1.4 We may update these Terms from time to time. The version in force when you enter a competition will apply to that entry. Changes will not be applied retrospectively where doing so would materially disadvantage an existing entrant.

2. The Competitions

2.1 We run prize competitions and free draws from time to time (each a Competition).

2.2 The relevant page for each Competition (the Competition Page) will state the prize, entry price (if any), opening and closing dates and times, maximum number of entries (if any), entry limits, available entry methods, draw method and any other significant conditions.

2.3 The closing date and time shown on the Competition Page is the Closing Date. We must receive all entries before the Closing Date. Entries received after it will not be accepted.

2.4 Where a Competition has a maximum number of entries, it may close early when all available entry numbers have been allocated. Any early-closing arrangement will be explained on the Competition Page.

3. Eligibility

3.1 Competitions are open only to individuals who:

• are aged 18 or over at the time of entry;

• are legally resident in England, Scotland, Wales or Northern Ireland; and

• comply with these Terms and any conditions on the Competition Page.

3.2 Competitions are not open to:

• our employees or the employees of any holding or subsidiary company;

• employees of our agents, suppliers or professional advisers who are directly connected with the Competition or its administration; or

• members of the immediate family or household of any person listed above.

3.3 By entering, you confirm that you are eligible to enter and claim a prize. We may require reasonable evidence of your identity, age, address and eligibility, including photographic identification, before accepting an entry or awarding a prize.

3.4 You are responsible for ensuring that your participation is lawful in the place from which you enter. We accept no responsibility for entries made unlawfully or from outside the permitted territory.

3.5 Entries are personal to the registered account holder. Entries on behalf of another person, joint entries, syndicate entries and entries made using false or misleading details are not permitted.

4. How to Enter

4.1 Each valid entry is represented by a unique entry number (an Entry Number). An Entry Number may be selected by you or allocated automatically, as stated on the Competition Page.

4.2 Unless the Competition Page states otherwise, entries may be made using the following routes:

A. Paid online entry

4.3 Create or sign in to your Website account, visit the Competition Page, select the number of entries required, answer any entry question where applicable, provide the information requested and complete payment using an available payment method.

4.4 Each successfully completed paid entry is a separate transaction between you and us. Your entry is not complete until payment has been authorised and an Entry Number has been allocated.

B. Free postal entry

4.5 You may enter without paying an entry fee by following all requirements in Schedule 1. Postal entries have the same chance of winning as paid online entries and will be included in the same draw.

4.6 You are responsible for the cost of postage. One correctly completed postcard is required for each entry. Postal entries must be received before the Closing Date.

C. Quick Draw telephone entry

4.7 A telephone entry route is available only where a Competition is displayed with a Quick Draw tag and runs for fewer than four days. The requirements are set out in Schedule 1. For all other Competitions, the free postal route must be used.

4.8 We do not impose a premium-rate charge for the telephone entry route, but your telephone provider’s usual call charges may apply.

4.9 Entry by any permitted route creates a legally binding agreement between you and us on these Terms. We recommend saving or printing a copy for your records.

5. Entry Restrictions and Invalid Entries

5.1 Any maximum number of entries per person or household will be stated on the Competition Page and applies across all entry routes unless expressly stated otherwise.

5.2 We may reject or void entries that we reasonably believe:

• were automatically generated, submitted in bulk or completed by a third party;

• are illegible, incomplete, altered, reconstructed, forged or tampered with;

• were received after the Closing Date;

• cannot be matched to a valid registered account;

• exceed an applicable entry limit;

• use multiple names, accounts or addresses to avoid an entry restriction;

• resulted from a payment that was reversed, cancelled, fraudulent or unauthorised; or

• otherwise breach these Terms or undermine the fair operation of the Competition.

5.3 Conduct contrary to the spirit or intention of a Competition may result in disqualification where that decision is reasonable and proportionate.

5.4 Proof of payment, posting, transmission or attempted submission is not proof that we received a valid entry.

5.5 We are not responsible for entries that are lost, delayed, corrupted, misdirected or not received because of a postal, communications, technical, payment-provider or network failure outside our reasonable control.

6. Entry Payments, Cancellations and Refunds

6.1 The price of an online entry will be shown on the Competition Page before purchase.

6.2 Paid Competition entries are generally non-refundable once an Entry Number has been allocated, except where:

• we cancel the Competition;

• a refund is required by law; or

• these Terms expressly provide otherwise.

6.3 We may cancel, suspend, extend or amend a Competition where reasonably necessary because of fraud, technical failure, a legal or regulatory requirement, prize unavailability or an event beyond our reasonable control. We will act fairly, publish an appropriate notice and avoid disadvantaging entrants where reasonably possible.

6.4 If we cancel a Competition without completing a draw, we will refund paid entry fees using the original payment method where reasonably possible. Promotional credits and WONIT Points used for an entry may instead be restored to the relevant Wallet with their original expiry date or a reasonable replacement expiry period.

6.5 We will not extend a Competition merely because insufficient paid entries have been sold unless that possibility and the relevant conditions were clearly stated on the Competition Page when entry opened.

7. Selecting the Winner

7.1 Unless the Competition Page describes a different lawful method, the winner (the Winner) will be selected at random from all valid Entry Numbers using Google Random Number Generator, Random.org or comparable independently verifiable random-selection technology.

7.2 The draw will take place either:

• live on a social-media channel identified on the Competition Page; or

• automatically through the Website,

normally within seven days after the Closing Date.

7.3 Paid, postal and eligible telephone entries will be entered into the same draw and treated equally.

7.4 Our decision is final on matters requiring the reasonable application of these Terms. This does not affect your statutory rights or prevent you from raising a complaint.

8. The Prize

8.1 The prize (the Prize) is described on the Competition Page. The Prize is subject to any restrictions, specifications or exclusions stated there.

8.2 A cash alternative is available only if it is displayed on the Competition Page or offered by us. Where a displayed cash alternative is available, the Winner must elect to receive it by emailing us within five working days after the later of:

• our first direct contact with the Winner; and

• publication of the winning Entry Number.

8.3 Unless these Terms or the Competition Page state otherwise, a Prize is non-transferable, non-negotiable and may not be exchanged.

8.4 If the advertised Prize or a reasonable equivalent becomes unavailable for reasons outside our reasonable control, we may substitute a prize or cash amount of equal or greater value. We will not substitute a materially less valuable prize.

8.5 Images used to advertise a Prize are illustrative. Where relevant, the exact make, model, colour, age, mileage, condition, specification and included accessories will be stated on the Competition Page.

9. Winner Notification and Publication

9.1 We will contact the Winner as soon as reasonably practicable using the email address or telephone number registered to the winning account. Entrants must keep their contact information accurate before the Closing Date.

9.2 We may require the Winner to provide reasonable proof of identity, age, residence and eligibility before releasing the Prize.

9.3 Subject to applicable law and the Winner’s rights, we may publish or make available the Winner’s surname, county and winning Entry Number. An entrant may object to publication or request that the amount of information published be reduced by contacting us, although we may still be required to provide information to the Advertising Standards Authority or another regulator.

9.4 We may ask the Winner to participate in reasonable publicity, but participation will not be a condition of receiving the Prize unless this was clearly disclosed on the Competition Page before entry and is lawful.

9.5 If, after reasonable efforts, we cannot contact the Winner, verify eligibility or receive a valid claim within 21 days of our first attempted notification, we may withdraw the Winner’s entitlement and select an alternative winner from the remaining valid Entry Numbers using the same method.

10. Delivery and Collection

10.1 We aim to deliver or make the Prize available within 14 days after the Winner has been verified, unless a different timescale is stated on the Competition Page or circumstances outside our reasonable control cause delay.

10.2 Delivery or collection arrangements will be agreed with the Winner. Standard delivery within the permitted UK territory will be paid by us unless the Competition Page clearly states otherwise. The Winner may be responsible for additional costs caused by bespoke requirements, failed delivery or redelivery.

10.3 If the Prize is a motor vehicle:

• we will arrange transfer of the registered keeper details using the appropriate DVLA process;

• the Winner is responsible for insurance, vehicle tax, licensing and all costs arising after handover;

• the Winner must hold any licence legally required to drive the vehicle; and

• any known material condition, mileage or history information will be stated on the Competition Page or supplied before handover.

11. WONIT Wallet and WONIT Points

11.1 Registered customers may have a digital wallet linked to their Website account (the WONIT Wallet). The Wallet holds WONIT Points awarded as Competition prizes, promotional credits, refunds or account adjustments made by us.

11.2 Where a Competition Prize includes WONIT Points, the Points will be credited directly to the Winner’s Wallet after the Winner has been verified.

11.3 Each WONIT Point is worth 1p (£0.01) of Website credit. For example, 1,000 WONIT Points are worth £10.00 of Website credit.

11.4 WONIT Points may be used at checkout towards eligible Competition entries and other eligible purchases on the Website. If the available balance does not cover the full price, a remaining balance may be paid using another payment method where the Website supports split payment.

11.5 WONIT Points are valid for 365 days from the date on which they are credited to the Wallet. Unused Points expire automatically at the end of that period and cannot then be restored or used, except where we are required by law to do so or where an error by us prevented their use.

11.6 WONIT Points:

• are Website credit only and are not money, a bank deposit or a general-purpose payment facility;

• have no cash value outside the Website;

• cannot be withdrawn, exchanged for cash, paid to a bank account or payment card, sold, assigned or transferred to another person or account;

• may be used only through the account to which they were credited; and

• do not earn interest.

11.7 Promotional Points or credits may be subject to additional conditions clearly communicated when they are issued. If additional terms conflict with this section, the more specific promotional terms will apply to those Points, provided they are fair and lawful.

11.8 You are responsible for keeping your account login details secure and must notify us promptly if you suspect unauthorised access.

11.9 We may correct Points credited or deducted in error. We may suspend use of a Wallet while we reasonably investigate suspected fraud, misuse, unauthorised activity or a breach of these Terms. We may remove Points obtained through fraud or material breach, but will not remove legitimately earned Points without a valid reason.

11.10 Closing an account does not create a right to a cash payment for unused Points. Any treatment of Points following closure will be subject to applicable law and the reason for closure.

12. Instant Win Competitions

12.1 Where the Website offers instant-win or slots-style Competitions, the Competition Page will explain how winning outcomes are allocated, the available prizes, the applicable entry routes and when a result is revealed.

12.2 Valid free entries must have an equal chance of winning and will not be treated less favourably than paid entries.

12.3 Where necessary to avoid disadvantaging a valid postal entrant because an advertised instant-win opportunity concluded before their entry could reasonably be processed, we may provide equivalent Website credit or an entry into a comparable Competition. Any substitute must offer a fair and materially equivalent opportunity and will not affect statutory rights.

13. Data Protection and Marketing

13.1 We process personal data in accordance with our Privacy Policy and Cookie Policy, including for account administration, entry processing, fraud prevention, age and identity checks, winner selection, prize fulfilment and compliance with legal obligations.

13.2 Where a Prize is supplied or fulfilled by a third party, we may share the Winner’s details with that party only to the extent reasonably necessary to verify or deliver the Prize, or where the Winner has separately consented.

13.3 Entering a Competition or creating an account does not by itself require you to consent to marketing. We will send electronic marketing only where we have a lawful basis to do so, including valid consent or where the law permits the customer “soft opt-in”. You can unsubscribe at any time using the link in a marketing message or by contacting us.

13.4 We may retain and disclose winner information where required by law, the CAP Code, the Advertising Standards Authority or another competent regulator.

14. Intellectual Property and Entry Materials

14.1 The Website and its content are owned by or licensed to us and are protected by intellectual-property laws. You may use the Website only for personal, lawful purposes in accordance with Schedule 3.

14.2 You retain ownership of material you submit with an entry. You grant us a non-exclusive, worldwide, royalty-free licence for the duration of the relevant intellectual-property rights to use, reproduce and publish that material only as reasonably necessary to administer and publicise the Competition and our business.

14.3 You confirm that material you submit is your own, does not infringe another person’s rights and is not unlawful, defamatory or offensive.

15. Liability

15.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.

15.2 Subject to clause 15.1, we are not responsible for loss or damage that was not reasonably foreseeable when you entered the Competition or that results from your failure to comply with these Terms.

15.3 We are not responsible for business losses. The Website and Competitions are provided for personal and domestic participation only.

15.4 We are not responsible for delay or failure caused by an event outside our reasonable control, but we will take reasonable steps to minimise its effect and protect entrants’ interests.

15.5 Your statutory rights are not affected.

16. Suspension, Disqualification and Account Closure

16.1 We may suspend an entry or account while reasonably investigating suspected fraud, payment abuse, account manipulation, unlawful conduct, security incidents or a material breach of these Terms.

16.2 We may disqualify an entrant, void affected entries or close an account where, following a reasonable investigation, we determine that a material breach or abuse occurred. Any action taken will be proportionate to the circumstances.

16.3 Where paid entries are void because of the entrant’s fraud or deliberate material breach, no refund will be due unless required by law. This does not permit us to retain money where doing so would be unfair or unlawful.

17. Complaints

17.1 If you have a complaint, contact info@wonit.co.uk with your name, account email, the relevant Competition and details of the issue.

17.2 We will acknowledge and investigate complaints within a reasonable period. Nothing in this section limits your right to contact the Advertising Standards Authority, a consumer-protection body or a court.

18. General

18.1 If any provision of these Terms is found unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

18.2 A delay or failure by us to enforce a provision is not a waiver of our right to enforce it later.

18.3 We may transfer our rights and obligations under these Terms to another organisation, but only where this does not reduce your rights. You may transfer your rights only with our written consent, except where the law permits otherwise.

18.4 No person other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999, except that a prize-supply partner may enforce a provision that expressly grants it a benefit.

18.5 Schedule 1 and Schedule 3 form part of these Terms.

19. Governing Law and Jurisdiction

19.1 These Terms, each Competition and any dispute or claim arising out of or in connection with them, including a non-contractual dispute or claim, are governed by the laws of England and Wales.

19.2 If you are a consumer resident in another part of the United Kingdom, you also benefit from any mandatory protections provided by the law of the part of the United Kingdom in which you live.

19.3 The courts of England and Wales will have jurisdiction. If you are a consumer resident in Scotland, you may also bring proceedings in the Scottish courts. If you are a consumer resident in Northern Ireland, you may also bring proceedings in the Northern Irish courts.

Schedule 1: Free Postal and Quick Draw Telephone Entries

1. Free Postal Entry

1.1 Before sending a postal entry, create a free Website account using your full legal name, date of birth, postal address, email address and telephone number.

1.2 Send one unenclosed postcard per entry by first-class or second-class post to:

1.3 Each postcard must clearly state:

• the exact name of the Competition;

• your full legal name;

• your date of birth;

• your full postal address;

• the email address registered to your Website account;

• your telephone number; and

• the answer to any entry question shown on the Competition Page, where applicable.

1.4 You must be aged 18 or over when you submit the entry. The details on the postcard must be legible and must match the details on your registered account. If we cannot identify and match the account, the entry will be rejected.

1.5 Only one entry may be submitted on each postcard. Multiple postcards may be sent, subject to the Competition’s entry limit. Mechanically reproduced, bulk-delivered or otherwise non-compliant entries may be rejected.

1.6 We must receive the postcard before the Closing Date. Allow sufficient delivery time. We are not responsible for post that is lost, damaged, delayed or misdirected, and proof of posting is not proof of receipt.

1.7 After a valid postcard is processed, we will allocate an Entry Number and normally send confirmation by email. Postal entries are included in the same draw and have the same chance of winning as paid entries.

1.8 We will make a reasonable number of entries available for postal participants and allow a reasonable period for postal entries to arrive. A Competition will normally remain open for at least four working days unless it is a qualifying Quick Draw with a telephone entry route.

 

Schedule 2: Events Outside Our Reasonable Control

An event outside our reasonable control may include:

• flood, drought, earthquake, epidemic, pandemic or other natural disaster;

• terrorist attack, civil commotion, riot, war, armed conflict, sanctions or embargo;

• nuclear, chemical or biological contamination;

• a change in law or action by a government, court or public authority;

• collapse of buildings, fire, explosion or accident;

• interruption or failure of utilities, telecommunications, hosting, payment or other essential third-party services;

• a serious cyber incident or malicious attack; or

• another circumstance that could not reasonably have been prevented or overcome.

Schedule 3: Website Terms of Use

1. Using the Website

1.1 The Website is operated by Wonit Ltd. By using it, you agree to this Schedule and the rest of these Terms. If you do not agree, do not use the Website.

1.2 The Website is intended for residents of England, Scotland, Wales and Northern Ireland aged 18 or over.

1.3 We may update, suspend, restrict or withdraw all or part of the Website for legal, security, technical, maintenance or business reasons. We do not guarantee uninterrupted availability, but will take reasonable steps to minimise disruption.

1.4 You are responsible for ensuring that anyone using the Website through your internet connection understands and complies with these Terms.

2. Accounts and Security

2.1 You must provide accurate, current information and keep your account details up to date.

2.2 You must keep your password, Entry Numbers and security information confidential. Notify us promptly at info@wonit.co.uk if you know or suspect that another person has accessed your account or security information.

2.3 We may disable access credentials or temporarily suspend an account where reasonably necessary to protect you, us, other users or the integrity of a Competition.

3. Acceptable Use

3.1 You must not:

• use the Website unlawfully, fraudulently or to harm another person;

• introduce malware or other harmful code;

• attempt to gain unauthorised access to the Website, its servers, databases or connected systems;

• attack the Website through a denial-of-service or distributed denial-of-service attack;

• scrape, copy or automate interactions with the Website without our written permission; or

• interfere with a Competition, draw, payment, account, Wallet or security process.

3.2 We may report suspected criminal conduct to law-enforcement authorities and cooperate with a lawful investigation.

4. Website Content and Intellectual Property

4.1 We own or license the intellectual-property rights in the Website and its content. All rights are reserved.

4.2 You may print or download reasonable extracts for personal, non-commercial use. You must not modify, republish, sell or commercially exploit Website content without written permission from us or the relevant owner.

4.3 Our status and that of identified contributors as authors must be acknowledged where appropriate.

4.4 Website content is provided for general information. Although we take reasonable care, we do not guarantee that all content is complete, accurate or current. Competition-specific information on a Competition Page remains subject to the main Terms.

5. Links

5.1 Third-party links are provided for information only. We do not control and are not responsible for third-party websites or their content.

5.2 You may link fairly and lawfully to our home page, provided you do not damage our reputation, imply an association or endorsement that does not exist, frame the Website or link from an unlawful website. We may withdraw permission where reasonably necessary.

6. Technology and Security

6.1 You are responsible for configuring and protecting your devices, software and internet connection. You should use appropriate security and virus-protection software.

6.2 We take reasonable steps to protect the Website but do not guarantee that it will always be secure or free from bugs or harmful material.

7. Payments

7.1 Available payment methods will be shown at checkout and may change from time to time. A payment method is accepted only when the relevant payment provider authorises the transaction.

7.2 Payment and Wallet use are also governed by clauses 6 and 11 of the main Terms.

8. Priority and Governing Law

8.1 If this Schedule conflicts with the main Terms, the main Terms prevail.

8.2 Clause 19 of the main Terms applies to this Schedule.
